Pocas horas antes de la escritura de estas lineas, surgía la noticia del hallazgo de unos huesos en Vecindario (Gran Canaria, España). Concretamente se han encontrado un craneo pequeño, un hueso largo (sin especificar al momento actual) y una bolsa con ropa. Este hecho, ya ha sido confirmado a los medios de comunicación por el Ministerio del Interior de España.

Para aquellos lectores de fuera de España es preciso puntualizar que en esa misma zona, desapareció un niño de siete años (Yeremi Vargas) en el año 2007 cuando jugaba en un solar en las inmediaciones de su casa. El caso supuso una de las desapariciones de menores mas mediáticas, de modo que solo el nombre de Yeremi Vargas evoca uno de los episodios negros no resueltos sobre la desaparición de un menor en España.

Tras el hallazgo por los vecinos de la zona, y puesta en conocimiento del cuerpo policial del que dependa el lugar del hallazgo, se comunica el mismo al juez instructor de guardia del partido judicial y éste pone en marcha la comisión judicial, que puede estar compuesta por juez, secretario judicial y médico forense, o como viene pasando en la mayoría de los casos de investigación de muertes violentas y/o sospechosas de criminalidad, el juez, en virtud del artículo 778.6 de la Ley de Enjuiciamiento Criminal (El juez podrá autorizar al médico forense que asista en su lugar al levantamiento del cadáver, adjuntándose en este caso a las actuaciones un informe que incorporará una descripción detallada de su estado, identidad y circunstancias, especialmente todas aquellas que tuviesen relación con el hecho punible); delegará la investigación del cadáver en el lugar de los hechos en la persona del médico forense.

Es este particular de la data, uno de los mas delicados, pues se pueden tomar por restos  de una muerte reciente y por tanto sujeta a investigación judicial, unos restos arqueológicos de interés meramente científico, y viceversa. Las ropas, el material que envuelva el cadáver, el material del ataud si es que existe, incluso el tipo de tierra que ha envuelto todo ello, las condiciones climáticas, etc; pueden variar el estado del cadáver dificultando por tanto el cálculo de la data. Datos como el estudio dental, curvatura de la diáfisis femoral (las culturas ancestrales pasaban gran parte del día en posición de cuclillas), los objetos encontrados alrededor, insectos; podrían orientar a un caso de tipo arqueológico. En los casos de investigaciones forenses, estamos valorando una data de semanas, meses o pocos años. Serán los objetos ajenos al propio cuerpo como ropa o enseres los que nos puedan dar pistas para acotar unos rangos temporales que con el estudio óseo como única fuente, serían demasiado amplios.

Ya en el ambiente controlado de la sala de autopsias, habrá que inventariar todo el material óseo encontrado, identificar todos y cada unos de los restos, comprobar que pertenezcan a un solo cadáver o a mas de uno, encontrar pruebas, restos o indicios que nos puedan dar alguna pista sobre la causa de la muerte, plantear las pruebas complementarias a realizar como análisis toxicológicos, histopatológicos, bioquímicos o biológicos.

Obviously, anthropological study is very important, because this DNA test, just identify the remains but all other data previously exposed, are at the expense of the proposed study.

A día de hoy, en el caso que nos ocupa, será la prueba de ADN la que nos dará una identificación inequívoca en el supuesto de que los restos identificados sean los de Yéremi Vargas. Evidentemente, el estudio antropológico es muy importante, pues esta prueba del ADN, tan solo identificará los restos pero todos los demás datos anteriormente expuestos, quedan a expensas del estudio planteado.

Esperemos pues, los resultados definitivos.
