One of the themes that has filled the news in Spain (place of origin of this blog) has been the case with the arrest of the alleged pedophile of Ciudad Lineal in Madrid.
Hagamos una pequeña introducción para aquellos lectores de fuera de España (que nos consta que son bastantes). Según los datos confirmados por el Ministerio del Interior de España, en septiembre de 2013 en el barrio de Ciudad Lineal en la capital de España, se inicia una serie de secuestros que tenían unas horas de duración y durante los cuales, presuntamente las niñas secuestradas, ttambien eran abusadas sexualmente. Esta situación se ha dado hasta el mes de septiembre de 2014, fecha en la que presuntamente hubo un último intento de agresión que culminó con la detención del presunto autor de los hechos.

Afortunadamente esta es una tendencia que está cambiando drásticamente gracias a la concienciación de los padres.

A nivel popular está siendo catalogado como un monstruo insano que algún tipo de trastorno debe padecer para haber llegado a (presuntamente) cometer este tipo de actos si es que se demuestra este particular. Efectivamente, la pedofilia se encuentra catalogada como trastorno diagnosticable en ambos manuales diagnostico estadisticos de los trastornos psiquiñatricos (DSM/CIE). Pero a efectos prácticos, ¿Influirá la confirmación del diagnostico en la imputabilidad penal del acusado?. De un modo general, se podría afirmar que el trastorno sexual expuesto, no va a dar lugar por si mismo una modificación de las bases psicobiológicas de la imputabilidad penal. No obstante cada caso deberá ser analizado individualmente en base a valorar todas las circunstancias concurrentes y antecedentes personales, debido a que en determinadas ocasiones, la alteración de la esfera sexual es una mas entre otras patologías como determinadas psicosis o cuadros de abuso y dependencia a sustancias tóxicas, que considerados en conjunto si podrían dar lugar a una modificación en la capacidad de comprender la ilicitud del acto y/o alterar la capacidad de actuar conforme a tal entendimiento. No parece ser el caso. En base a que la información de la que disponemos se basa exclusivamente la ofrecida en prensa, nos permitirán nuestros estimados lectores no puntualizar mas concretamente sin haber estudiado las actuaciones judiciales incoadas.
