La medicina en el derecho
Existe una certeza entre peritos médicos en la cual se afirma que cuando un asunto que surge entre “batas blancas”, termina se dirimiendo entre “batas negras”, todos acabamos perdiendo de una forma u otra. Hace referencia a la vestimenta habitual de médicos (batas blancas), frente a la normalmente portada por jueces y magistrados en el ejercicio de sus funciones (batas negras).
The doctor and the justice
A certainty exists between medical experts in which one affirms that when a matter that arises between “white robes”, ends being dissolved between “black robes”, we all end up by losing of a form or other one. It refers to the habitual clothing of doctors (white robes), opposite to normally carried by judges and magistrates in the exercise of its functions (black robes).
No es la primera vez que reflexionamos en amplia-mente.com sobre la relación, en ocasiones bastante estrecha, entre Derecho y Medicina. La última, precisamente se tituló Batas negras, batas blancas.

Y es que pocas cosas angustian mas a un médico que su comparecencia ante la Justicia, y no solo nos referimos en calidad de investigado; sino que también hacemos extensiva esta ansiedad a la “simple” prestación de declaración como testigo en el ejercicio de sus funciones. Es normal, a nadie se le prepara en su profesión (excepto a los profesionales del Derecho, evidentemente) para ejercerla delante de un juez, pues una declaración judicial no deja de ser una prestación profesional que ejerce un médico ante una necesidad puntual de la Justicia.
And the fact is that few things distress more a doctor that its appearance before the Justice, and not only we refer as investigated, but also we do extensively this anxiety to the «simple» declaration service like witness in the exercise of its functions. It is normal, he is prepared for nobody in its profession (except to the professionals of the Law, obviously) to exercise it in front of a judge, since a judicial declaration does not stop being a professional service that a doctor exercises before a punctual need for the Justice.
No obstante, por mucho que pretendamos vestir de normalidad el acto de confluencia con la Justicia, no es algo que un médico haga con el agrado que pueda afrontar la jornada laboral en “su ambiente controlado”.
Nevertheless, for much that we try to dress in normality the confluence act in the Justice, it is not anything that a doctor does with the taste that it could confront its working day in “its controlled ambience”.
Este ha sido uno de los temas tratados en la Jornada sobre “Actualización Médico-Legal” promovida por la Organización Médico Colegial. La primera mesa redonda, analizó la actuación del medico ante la Justicia, el consentimiento informado y el secreto profesional.
This has been one of the topics treated in the Day on «medical – legal update” promoted by the Professional Medical Organization. The first round table, he analyzed the performance of the doctor before the Justice, the informed assent and the professional secret.
En esta mesa y como decíamos anteriormente, se trató sobre la manera de actuar de un médico como testigo, que en el caso que nos ocupa, será cualificado, pues lo es en virtud de una serie de conocimientos técnicos, pero que en caso de ser citado como testigo, se ceñirá exclusivamente a aclarar determinadas cuestiones en relación al caso que le ha llevado a testificar, por lo que el médico simplemente se limita a relatar los hechos que ha vivido y por tanto se trata de un trámite por el que no ha de tener mas reparos que los que tendría al expresarlos en la propia historia clínica, que a pesar de ser una herramienta cotidiana en el ejercicio de la medicina, también es un documento oficial en la relación médico paciente.

Y precisamente en el transcurso de esa relación, surge uno de los puntos claves en la misma, que es consentimiento informado. No en vano, el 70% de las demandas es por deficiencias en el consentimiento informado. La errónea concepción de que la entrega de un documento estándar que el paciente firma sin comprender y en muchos casos sin leer, pues en caso de no ser firmado no podría acceder al procedimiento diagnóstico o terapéutico; no exime al médico de una responsabilidad legal llegado el caso.

El ultimo punto de la mesa inaugural fue el secreto médico. Se aclararon aquellos supuestos en los que el médico está legalmente obligado a comunicar los datos obtenidos en su relación con el paciente, como puedan ser circunstancias en las que exista un riesgo real de perjuicio para el paciente, el propio médico o terceras personas. Se dejo claro, asunto éste que algunos facultativos no lo tienen del todo, que el imperativo legal es causa de revelación del secreto médico. Quien hoy les escribe, ha podido comprobar como algunos médicos se han negado, en calidad de testigos en la vía penal, a revelar ciertos datos en base al secreto médico, hecho por el que han sido sancionados según la legislación vigente.

Como vemos, este tipo de iniciativas son sumamente provechosas para un colectivo que desconoce ciertos aspectos del funcionamiento de la Justicia, básicamente porque no se les ha preparado adecuadamente en dichos asuntos (la asignatura de medicina legal en a efectos prácticos eminentemente técnica, tratando muy de soslayo este tipo de cuestiones).
We see that this type of initiatives is extremely profitable for a group who does not know certain aspects of the functioning of the Justice, basically because it has not prepared them for itself appropriately in the above mentioned matters (the subject of legal medicine in to practical effects eminently skill, treating very obliquely this type of questions).

Desde amplia-mente.com animamos a la Organización Médica Colegial a que este tipo de jornadas proliferen mas y que se extiendan localmente a todos los colegios médicos del resto de provincias (no todos los profesionales pueden ir a Madrid, en jornada laboral, a formarse o actualizar sus conocimientos). Y puestos a lanzar peticiones, teniendo en cuenta los medios técnicos actuales, sería conveniente plantear este tipo de iniciativas en el plano online. Es cierto que muchos colegios médicos se quejan de que por mas oferta formativa que publiquen, los colegiados no acuden como desearían, pero hemos de pensar que un médico que trabaja en la mayoría de los casos más de cuarenta horas semanales (incluidas las guardias), lo último que desea un fin de semana o a última hora del día es dejar nuevamente de lado a su familia o circulo social cercano, para seguir trabajando en su formación. Por favor, consideremos la formación online, cuando y donde se quiera o pueda.
