No podemos negar que la Justicia, por mucho que represente un ideal a alcanzar por el ser humano, no deja de ser un fiel reflejo de la sociedad donde se aplica y como tal, absorbe todos sus aspectos.

Con fecha 1 de diciembre de 2015 ha entrado en vigor la Orden ESS/1187/2015, de 15 de junio, por la que se desarrolla el Real Decreto 625/2014, de 18 de julio, por el que se regulan determinados aspectos de la gestión y control de los procesos por incapacidad temporal en los primeros trescientos sesenta y cinco días de su duración.

Según la propia introducción contenida en la Orden del Ministerio de Empleo y Seguridad Social, las modificaciones aportadas en el RD 625/2014 han afectado a los portes médicos de baja y alta laboral, intentando con ello ahorrar burocracia, de modo que ahora se actuará en base a una serie de protocolos en los que el médico actuante estimará la duración aproximada del proceso de modo que en caso de cuadros muy banales en el mismo acto médico en el que se atiende al paciente, se expedirá el parte de baja laboral y a la vez el paciente saldrá de la consulta con el alta previsible para que se incorpore directamente a su puesto de trabajo sin la necesidad de tener que volver a pasar por el centro de salud a formalizar el alta. Evidentemente el trabajador tendrá derecho a ser reconocido el día del alta prevista y si no cumple con los requisitos de salud adecuados para desempeñar una actividad laboral, el facultativo podrá modificar la fecha estimada inicialmente y emitir una nueva estimación para alta o revisión del paciente.
