La temporada pasada, que ahora repasamos, tuvo un importante número de artículos en relación a la aplicación de pruebas complementarias objetivas en el diagnóstico psiquiátrico. Repasemos uno de estos artículos.
Last season, which we are now reviewing, had a significant number of articles in relation to the application of objective complementary tests in psychiatric diagnosis. Let us review one of these articles.

Gran parte del estigma, del que no se puede desprender la enfermedad mental, o mejor dicho, los enfermos mentales, se debe al enorme miedo que suscita en la población general.

Much of the stigma from which mental illness, or rather, the mentally ill, cannot be dissociated is due to the enormous fear it arouses in the general population.
Miedo por lo desconocido de este tipo de trastornos. La causa puede ser la falta de conocimiento generalizado sobre enfermedad mental, que a su vez puede ser un problema de comunicación entre los profesionales de la salud y la comunidad para la que trabajan. Esta puede ser parte del motivo del auge de los movimientos asociativos que vivimos en la actualidad, que precisamente, en base a este fenómeno de ausencia de información institucional, hace que pacientes y familiares “se tengan que buscar la vida” respecto a sus trastornos.
Fear of the unknown of this type of disorder. The cause may be a lack of widespread knowledge about mental illness, which in turn may be a problem of communication between health professionals and the community for which they work. This may be part of the reason for the rise of the associative movements that we live today, which precisely, based on this phenomenon of lack of institutional information, makes patients and families «find solutions» with respect to their disorders.

Pongámonos en el supuesto de que alguien ha cometido un ilícito penal y es puesto a disposición judicial. Unas veces por lo abigarrado del hecho, otras por la rareza del comportamiento del detenido en el momento de declarar ante el juez, y en la mayoría de los casos, por consejo de los asesores legales del investigado; se solicita el estudio de las bases psicobiológicas de la imputabilidad penal por parte del médico forense.
Let us assume that someone has committed a criminal offence and is brought to justice. Sometimes because of the variegated nature of the act, other times because of the rarity of the detainee’s behavior at the time of testifying before the judge, and in most cases, on the advice of the legal advisors of the person being investigated; the study of the psychobiological basis of criminal imputability by the forensic doctor is requested.
Esto quiere decir, que los profesionales que intervienen en la instrucción del caso, quieren tener respuesta a si el detenido conoce la ilicitud del hecho presuntamente cometido y/o si tiene capacidad volitiva para actuar conforme a este entendimiento.
This means that the professionals who intervene in the investigation of the case want to have an answer to whether the detainee knows the illegality of the allegedly committed act and/or whether he has the volitional capacity to act in accordance with this understanding.
Con las combinaciones de estos dos factores (capacidad intelectiva y volitiva), el psiquiatra forense, ha de responder al juez instructor si la patología alegada o detectada, ha podido influir en la presunta comisión del hecho. Como hemos comentado en artículos anteriores, como pueda ser en No todos, Señoría, “La enfermedad mental no es, no debe ser, una patente de corso para la comisión de actos ilícitos. El simple hecho de que una persona tenga diagnosticado un cuadro médico, no garantiza que se encuentre en un supuesto del articulado del Código Penal”. Es decir, para que una enfermedad mental de lugar a una modificación de la imputabilidad penal, ha de presentar sintomatología objetivable en el momento de la presunta comisión de los hechos.

As we have commented in previous articles, as may be the case in Not All, Sir, «Mental illness is not, should not be, a Corsican patent for the commission of unlawful acts. The simple fact that a person has been diagnosed with a medical condition does not guarantee that he or she is in a situation covered by the provisions of the Criminal Code. In other words, in order for a mental illness to lead to a change in criminal liability, it must present objectifiable symptoms at the time of the alleged commission of the facts.

Toda prueba complementaria objetiva, en el sentido de ser una prueba mensurable, es mas que bienvenida en una pericia que por sus características, suele ser bastante subjetiva. Human personality reflectas spatio-temporal and time-frequency EEG structure, es un artículo publicado como open access en Plos One, en el que sus autores vienen a comunicar un vínculo entre las ondas electroencefalográficas, la capacidad intelectiva y los rasgos de personalidad.
Any objective complementary evidence, in the sense of being a measurable proof, is more than welcome in an expertise that, due to its characteristics, is usually quite subjective. Human personality reflectas spatio-temporal and time-frequency EEG structure, is an article published as open access in Plos One, in which its authors come to communicate a link between electroencephalographic waves, intellectual capacity and personality traits.
La metodología seguida, consistió en someter a los sujetos de estudio a registro EEG mientras realizaban tareas sencillas que requerían cierto esfuerzo a nivel cognitivo. Igualmente se les pasó el cuestionario 16PF de Cattell. Según los autores, los distintos grupos de estudio, mostraron una relación significativa entre los resultados de las pruebas psicométricas y sus registros electroencefalográficos.
The methodology followed consisted of subjecting study subjects to EEG registration while performing simple tasks that required some effort at the cognitive level. They were also given Cattell’s 16PF questionnaire. According to the authors, the different study groups showed a significant relationship between the results of the psychometric tests and their electroencephalographic records.
This type of studies, which in many cases end up giving rise to concrete evidence, applicable to daily practice, would provide forensic psychiatry with a powerful tool with which to argue the reports on intellectual and volitional abilities, with which the judges would later decide on the criminal imputability of the investigated.

Este tipo de estudios, que en muchos casos terminan dando lugar a pruebas concretas, aplicables a la práctica diaria, dotarían a la psiquiatría forense de una poderosa herramienta con la que argumentar los informes sobre capacidades intelectivas y volitivas, con los que posteriormente los jueces decidirían sobre la imputabilidad penal de los investigados.
