El pasado lunes, compartíamos con ustedes, estimados lectores, una actualización de las investigaciones sobre el uso de la GHB. En GHB ¿endógeno o exógeno?, esa es la cuestión, el Dr. Díaz reflexionaba sobre el procedimiento analítico a fin determinar y diferenciar la fracción de producción endógena de esta sustancia frente a la realmente aplicada desde el exterior.

New psychoactive substances in the laboratory

Last Monday, we shared with you, dear readers, an update on research into GHB use. In GHB, endogenous or exogenous, that´s the question, Dr. Diaz reflected on the analytical procedure to determine and differentiate the fraction of endogenous production of this substance from that actually applied from the outside.

Este tipo de cuestión es muy delicada desde el punto de vista pericial y tal y como cerraba el artículo el Dr. Díaz, pues aun son muchas las dudas en los casos de estudio en sujetos vivos.

This question is very delicate from an expert point of view and as Dr. Diaz closed the article, there are still many doubts in the case studies on living subjects.

Pero no es la GHB la única droga a analizar en casos de intoxicaciones con trascendencia judicial, y no solo se estudia el consumo de sustancias psicotrópicas y/o estupefacientes en los casos de sumisión química en el caso de personas vivas. Estudios de las bases psicobiológicas de la imputabilidad penal en relación con el consumo de drogas, así como modificaciones de las penas o incluso la suspensión de las mismas, forman gran parte del estudio de drogas en el sujeto vivo implicando la realización de estudios analíticos.

But GHB is not the only drug to be analyzed in cases of intoxication with judicial significance, and not only the consumption of psychotropic and/or narcotic substances is studied in cases of chemical submission in the case of living persons. Studies of the psychobiological bases of criminal imputability in relation to drug consumption, as well as modifications of sentences or even the suspension of sentences, form a large part of the study of drugs in the living subject involving analytical studies.

En España, cuando un médico forense ha de estudiar la presencia de una sustancia tóxica, ha de remitir las muestras obtenidas a un laboratorio que las analice. En los casos en los que el Instituto de Medicina Legal al que pertenezca tenga un servicio de laboratorio, las remitirá a dicho servicio. Si el análisis cualitativo resulta positivo, se pasaría al estudio cuantitativo si existe la posibilidad o se remitiría la muestra al Instituto Nacional de Toxicología como laboratorio de referencia para el Ministerio de Justicia. En los casos de Institutos de Medicina Legal sin servicio de laboratorio, se remitirán directamente al Instituto Nacional de Toxicología.

In Spain, when a forensic doctor has to study the presence of a toxic substance, he or she has to send the samples obtained to a laboratory for analysis. In cases where the Forensic Medicine Institute to which he belongs has a laboratory service, he will refer them to that service. If the qualitative analysis is positive, the quantitative study will be carried out if possible, or the sample will be sent to the National Institute of Toxicology as a reference laboratory for the Ministry of Justice. In the cases of Forensic Medicine Institutes without a laboratory service, they will be sent directly to the National Institute of Toxicology.

En todos los casos, el médico forense debe informar al laboratorio actuante sobre la sospecha que tenga respecto a la sustancia a analizar y con arreglo a ello hará la petición analítica.

In all cases, the forensic doctor must inform the acting laboratory of the suspicion he has regarding the substance to be analysed and will make the analytical request accordingly.

En determinadas ocasiones, como pueda pasar en los casos de agresiones sexuales o como pueda pasar también en los delitos contra la seguridad del tráfico, las analíticas se han podido adelantar (sin perjuicio de que se siga de manera paralela por el cauce explicado en el párrafo anterior) realizando en algún laboratorio de los servicios sanitarios de la sanidad pública, con lo que cobra especial importancia la batería de pruebas para las que esté preparado el laboratorio hospitalario donde se haga la analítica. No es de extrañar que a día de hoy, los laboratorios de urgencias de hospitales públicos, tan solo puedan buscar las drogas mas usuales y tradicionales.

On certain occasions, as may happen in cases of sexual assault or in crimes against traffic safety, it has been possible to carry out the analyses in advance (without prejudice to continuing in parallel along the lines explained in the previous paragraph) in a laboratory of the public health services, so that the battery of tests for which the hospital laboratory where the analysis is made is particularly important. It is not surprising that nowadays, public hospital emergency laboratories can only search for the most common and traditional drugs.

Pero, ¿qué pasa en el caso de las nuevas sustancias psicoactivas? Lo habitual en ese análisis rápido que se hace tras una agresión sexual o a ese conductor que no está de acuerdo con la medición en el control de tráfico y pide contra análisis de sangre, es que no se puedan analizar las sustancias de última aparición, sin que ello signifique que no hayan podido intervenir en la génesis del hecho disruptivo que da lugar al análisis.

But what about the new psychoactive substances? The usual thing in that quick analysis that is done after a sexual aggression or to that driver who does not agree with the measurement in the traffic control and asks for blood tests, is that the substances of last appearance cannot be analyzed, without this meaning that they have not been able to intervene in the genesis of the disruptive fact that gives rise to the analysis.

Igualmente, deberemos tener en cuenta que no todas las matrices son idóneas para según que análisis. Sangre y orina son las matrices habituales a nivel asistencial, pero no las idóneas en todo momento. Saliva en el caso de consumos recientes (recordemos que nos estamos refiriendo a estudio en sujeto vivo) o pelo y uñas en los casos de consumo crónico, no podrán ser analizados en una analítica de urgencia en un hospital de referencia.

Likewise, we must take into account that not all matrices are suitable for certain analyses. Blood and urine are the usual matrices at the care level, but not the ideal ones at all times. Saliva in the case of recent consumption (remember that we are referring to a study on a live subject) or hair and nails in cases of chronic consumption, cannot be analysed in an emergency analysis at a referral hospital.

Es por todo ello, que ante el auge de las nuevas sustancias psicoactivas, se mantenga el interés investigador en el esclarecimiento analítico de este tipo de nuevos consumos. Detection and quantification of synthetic cathinones and selected piperazines in hair by LC-MS/MS viene a esclarecer el panorama ante el uso de sustancias que son diseñadas para replicar el efecto de sustancias ilegales mas tradicionales, pero con mas potencia y lo peor, no detectables mediante las pruebas diagnosticas ideadas para esas sustancias tradicionales a las que imitan.

For all these reasons, in view of the rise in new psychoactive substances, research interest should be maintained in the analytical clarification of this type of new consumption. Detection and quantification of synthetic cathinones and selected piperazines in hair by LC-MS/MS comes to clarify the panorama before the use of substances that are designed to replicate the effect of more traditional illegal substances, but with more power and the worst, not detectable by the diagnostic tests designed for these traditional substances that they imitate.

En el artículo enlazado, se refiere como se ha procedido a desarrollar, validar y darle un uso práctico a un método de trabajo en el que se usa la cromatografía líquida en tándem con espectrometría de masas para la detección de 35 catinonas sintéticas y piperazinas en cabello. Según los autores del estudio, los resultados de los análisis efectuados se obtenían en una media de 12 minutos con una aceptable precisión y sesgo.

In the article linked, it is referred how it has been developed, validated and given a practical use to a working method in which it is used the liquid chromatography in tandem with mass spectrometry for the detection of 35 synthetic catinones and piperazines in hair. According to the authors of the study, the results of the analyses performed were obtained in an average of 12 minutes with an acceptable precision and bias.

Vemos con estudios como el presente, la adaptación de los laboratorios a las tendencias en el consumo sustancias estupefacientes, como único camino para llegar a la verdad del consumo a estudiar y en los casos forenses, al fondo de los hechos a enjuiciar.

We see with studies like the present one, the adaptation of the laboratories to the tendencies in the consumption of narcotic substances, as the only way to arrive at the truth of the consumption to study and in the forensic cases, to the bottom of the facts to prosecute.

De manera paralela a estas adaptaciones en las baterías diagnósticas, creemos que es de suma importancia la formación continua en este tipo de sustancias y las vías de diagnóstico (y tratamiento en el caso de la medicina asistencial) para realizar diagnósticos fiables en casos que hace pocos años hubiesen dado resultados negativos ante la falta de recursos técnicos para el estudio de determinadas sustancias.

In parallel to these adaptations in the diagnostic batteries, we believe that continuous training in this type of substances and the ways of diagnosis (and treatment in the case of medical assistance) are of the utmost importance to make reliable diagnoses in cases that a few years ago would have given negative results due to the lack of technical resources for the study of certain substances.

Animamos por ello que las administraciones, tras la progresiva adaptación de las baterías diagnósticas de sus laboratorios, forme e informe a los responsables de dotar de muestras a analizar a esos laboratorios.

We therefore encourage the administrations, after the progressive adaptation of the diagnostic batteries of their laboratories, to train and inform those responsible for providing samples to be analysed in those laboratories.
